Advantages of Litigation Funding

In one of our earlier posts, we talked about the WHAT of Litigation Funding (LF). This one is about the WHY?



The major benefits of LF are:



 




  • LF bridges any gap that may exist in terms of the financial strength between the parties in dispute.

  •  LF helps Corporates & MSMEs (Micro, Small, and Medium Enterprises) de-risk their businesses and free up their working capital.

  •  LF provides an additional qualitative assessment of the claim to the claimant at no extra cost.

  •  And to top it all, most of the time LF is non-recourse, meaning that the Funder gets paid only on the successful outcome of the claim.



LF helps claimants fight for their rights and ensures that Justice is truly a reality for all.



In Miller UK Ltd. v. Caterpillar Inc., a small family-run company sued Caterpillar Inc., a Fortune 500 corporation for breach of contract and statutory trade secret misappropriation and was awarded compensatory damages of $24.9 million along with exemplary damages of $49.7 million on the statutory claim and $16 million on the contract claim.  



The value and effectiveness of LF in getting justice for society at large (read out earlier article on class action) is an extremely important aspect that makes the whole idea and concept of LF very appealing. In Merricks vs. Mastercard, a class action suit, funded by Innsworth Capital, Mastercard is being sued for a sum of ~ 14 billion € as damages for charging ‘interchange fees’ on the use of debit and credit cards between the period 1992 – 2008 infringing EU laws. The matter is sub judice before the Competition Appeal Tribunal, UK.
